Terms of Service

These Terms of Service ("Terms") govern your use of the TruthStone PM property management communication service ("Service") operated by TruthStone PM ("we," "us," or "our"). By using our Service, you agree to be bound by these Terms.

TruthStone PM provides an AI-powered communication agent that coordinates property management activities between property owners, tenants, and service providers. The Service facilitates maintenance request handling, vendor coordination, scheduling, and property status notifications through messaging platforms including SMS and instant messaging applications.

You must be at least 18 years of age to use our Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

4. SMS / Text Messaging Terms

By opting in to SMS messaging from TruthStone PM, you agree to the following terms:

Opt-In: You may choose to opt in to receive SMS messages from TruthStone PM by texting START to (213) 699-4149, or by providing written consent during property onboarding. Opting in is entirely voluntary and is your active decision. No property owner, landlord, or property manager can enroll you without your explicit consent.

Message Types: Messages from TruthStone PM are strictly non-marketing and operational. Message types include maintenance updates, scheduling coordination, vendor follow-ups, appointment confirmations, owner updates, and property status notifications.

Message Frequency: Message frequency varies based on property activity. You may receive multiple messages per day during active maintenance coordination, or no messages during periods of inactivity.

Costs: Message and data rates may apply depending on your mobile carrier and plan. TruthStone PM does not charge for receiving SMS messages; standard carrier rates apply.

Opt-Out: You may opt out of SMS messages at any time by replying STOP to any message from TruthStone PM. Upon opting out, you will receive a single confirmation message and no further SMS messages will be sent.

Consent Not Required for Service: Consent to receive SMS messages is not a condition of purchasing or receiving any service from TruthStone PM, nor is it a condition of tenancy or any service agreement. Alternative communication methods are available upon request — contact alexander@truthstonepm.com to discuss options.

Data Privacy: No mobile opt-in data (including phone numbers obtained through SMS opt-in) will be shared with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy for full details on data handling.

5. Fees and Payment

Service fees are based on the pricing tier selected by the property owner and are billed monthly. Pricing tiers are determined by portfolio size (number of units managed). Current pricing is available on our pricing page. We reserve the right to modify pricing with 30 days' written notice.

6. Service Availability

We strive to maintain continuous availability of the Service but do not guarantee uninterrupted operation. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any losses resulting from Service unavailability.

7. AI-Generated Communications

TruthStone PM uses artificial intelligence to generate and manage communications. While our AI agent is designed to handle property management coordination accurately and professionally, AI-generated communications may occasionally contain errors. Property owners are responsible for reviewing and verifying information related to repair approvals, cost estimates, and vendor selections. TruthStone PM is not responsible for decisions made based on AI-generated communications without owner review.

8. Limitation of Liability

To the maximum extent permitted by law, TruthStone PM shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claims arising from these Terms or the Service shall not exceed the total fees paid by you in the twelve (12) months preceding the claim.

You agree to indemnify and hold harmless TruthStone PM and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service or violation of these Terms.

10. Intellectual Property

All content, features, and functionality of the Service — including but not limited to text, graphics, logos, and software — are the property of TruthStone PM and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the Service without our written consent.

11. Termination

Either party may terminate the Service at any time with 30 days' written notice. We may suspend or terminate your access immediately if you violate these Terms. Upon termination, your right to use the Service ceases immediately. We will retain your data in accordance with our Privacy Policy.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Los Angeles County, California.

13. Changes to These Terms

We reserve the right to update these Terms at any time. Material changes will be communicated by posting the revised Terms on this page with an updated effective date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
